Employment relations

What should a business prepare before hiring its first team in Mexico?

Organize roles, employment conditions, records and responsibilities before hiring in Mexico, connecting paperwork with payroll, systems and daily operations.

Before hiring staff in Mexico, a business needs to define the work, its conditions, who will direct it and how the relationship will be administered. Connect those decisions with employment documentation, payroll, social security and internal processes. Preparing only an offer letter can leave operational questions unresolved when the person starts work.

Describe the relationship before choosing a document

Mexico's Federal Labor Law connects an employment relationship with paid, personally performed work under another party's direction. The title of an agreement therefore does not, by itself, determine the relationship. Actual duties and the way work is supervised form part of the assessment.

Start with a role description covering activities, supervision, working location, tools and coordination with others. If remote work, travel or access to sensitive information is anticipated, record those circumstances for review in the relevant context. A general job title may not reveal these practical requirements.

The proposed conditions should be understandable and consistent across recruitment, management and administration. Differences between a verbal promise, an offer and later documentation can create expectations that the business has not considered when planning the appointment or its ongoing costs.

Prepare for the person to join

  • Define duties, supervisory responsibility and initial objectives that help organize the work.
  • Review proposed terms, remuneration and other applicable elements with those responsible for formalizing the relationship.
  • Coordinate employer registration, employee enrollment and payroll processes where applicable; these are related but separate tasks.
  • Request necessary records and establish who may access personal employment files.
  • Arrange tools, system access, induction and guidance on safety and operating procedures.
  • Assign owners for questions, change records and communication throughout the relationship.

The IMSS procedure for companies distinguishes employer registration from employee enrollment notices. Confirming the appropriate route helps prevent a task from being treated as complete while a related step remains outstanding. The team should understand which person is accountable for each action rather than assuming another department has handled it.

Let the file follow the working relationship

Consider a company hiring its first salesperson and providing access to a customer database. Alongside formalizing the relationship, it needs to decide permissions, information use, reporting expectations and the eventual return of tools where relevant.

The employment file should reflect significant changes to duties or conditions and retain records in an organized manner. Someone also needs to understand what should be documented and when specialist review is appropriate. A stored template without clear ownership does not provide that follow-through.

An onboarding process can connect human resources, accounting and technology. Reviewing it after the first appointments helps identify unclear instructions and duplicate requests while keeping applicable obligations in view. The aim is a process people can actually follow, with documents reflecting what happens in the workplace.

Frequently asked questions

Does a services agreement rule out an employment relationship?

That cannot be concluded from the document's title. The assessment should consider how work is actually performed, including direction and payment, together with the applicable framework. Addressing the question before implementation helps define the appropriate arrangement.

Can every role use the same file?

A common foundation helps administration, but duties, risks and conditions may call for adjustments. Office staff, technical operations and remote work can raise different issues requiring review.

Next step: begin an employment-relations discussion with the proposed duties and team structure. This guide supports preparation; it does not determine the legal terms of an individual hiring arrangement.
